New Jersey Notary Requirements and Information

New Jersey Notary Commission Qualifications
Notary applicants must:
• be at least 18 years old;
• be a resident of the state of New Jersey or a resident of a bordering state that is regularly employed in the state of New Jersey;
• not have been convicted of a crime under the laws of any state or the United States, for an offense involving dishonesty, or a crime of the first or second degree.

Term of Office
5 year term.

Notary Education and/or Exam Requirement
Effective 7-22-2022, education and exam for new applicants and continuing education for renewing notaries will be required. (Attorney's are exempt from this requirement.)

Notary Bond Requirement
Not required.

Notary Recordbook (Journal) Requirement
Recordbook (journal) required, all paper and electronic notarial acts. Tangible or electronic format; only one recordbook at a time whether notarial acts are performed regarding tangible or electronic records. Certain specified Notaries are exempted from such recordkeeping.

Notary Seal Requirement
Effective October 20, 2021, Ink stamp or embossing seal required. Seal image must be photographically reproducible.

Authorized Duties
• Oaths/affirmations;
• verifications on oath or affirmation;
• acknowledgments and proofs;
• witness or attest signatures;
• certify safe deposit box contents;
• certify/attest a copy or deposition (including certifying that a tangible copy of an electronic record is an accurate copy of the electronic record);
• note protests.

Allowable Fees (For the Most Commonly Performed Notarial Acts)
$2.50 for oaths/affirmations, taking affidavits, proofs of a deed, and taking an acknowledgment. With respect to transfers of real estate, $15 for oaths/affirmations, taking affidavits, proofs of a deed, and taking acknowledgments of the grantors regardless how many such services are performed in a single transaction. For financing of real estate, the fee is $25 per transaction (not per document) for oaths/affirmations, taking affidavits, and taking acknowledgments of the mortgagors regardless how many such services are performed in a single transaction. Travel fees are not prohibited; American Society of Notaries recommends that any travel fees should be reasonable (current IRS per-mile rate for business travel or less), disclosed and agreed-to in advance, and billed separately from notarization fees.
