State Information for Alabama

Alabama Notary Public Commission Requirements and Information

All notaries appointed on or after January 1, 2012 shall perform all the acts and exercise all authority under the general laws of the State of Alabama. The jurisdiction of such notaries public shall not be limited to the counties of their residence and shall extend to any county of the state.

All existing notaries public functioning prior to January 1, 2012 shall continue to function pursuant to their existing authority for the remainder of their existing commission.

Appointing Officer
Alabama notaries are appointed by their probate judge within the various counties. The probate judge then reports to the Secretary of State the name, county, date of issuance and expiration date of each notary appointed and commissioned.

Qualifications vary from county to county.

→Effective January 1, 2012 Alabama notaries are no longer required to keep a fair register of all notarial acts.

Notary Seal Requirement
Ink Stamp or Embossing Seal Required*
→Since notarized documents submitted for authentication (apostille or certification) should display an embossed seal, notaries may wish to obtain/use both the ink stamp and embossing seal.

Authorized Duties
take acknowledgments and proofs (conveyances);
administer oaths;
execute protests; and
exercise such other powers, according to commercial usage or the laws of this state, as may belong to notaries public.
