Delaware Notary Requirements and Information

Delaware Notary Commission Qualifications
Notary applicants must:
• be at least 18 years old;
• be a legal resident of the state of Delaware OR maintain regular employment within the state AND have a physical business address;
• have a reasonable need for a commission;
• be of good character. (If convicted of a felony, he/she must have their civil rights restored. Anyone convicted of a crime involving dishonesty or moral turpitude is not eligible for a Delaware Notary commission.)
• A Limited Governmental Notary commission may be issued to any employee of any State of Delaware agency.
• A Service Organization Notary commission may be issued to one Notary for each State recognized veterans’ organization; or one Notary for each volunteer fire company or volunteer ambulance and rescue company.

• Traditional Notary – 2 years, new commission; 2 or 4 years, renewal commission.
• Limited Governmental Notary – in effect as long as Notary is employed with the agency for which the commission was obtained.
• Service Organization Notary – 4 years
• Electronic Notary – 2 years

Notary Education and/or Exam Requirement
Education required – electronic Notaries only.

Notary Bond Requirement
Not required.

Notary Recordbook (Journal) Requirement
• Paper notarial acts – Recordbook REQUIRED, Effective August 1, 2023
• Electronic notarial acts – electronic recordbook required.

Notary Seal Requirement
• Ink stamp or embossing seal required, paper notarial acts. Must be photographically reproducible; black ink specified.
• Electronic seal required/specified, electronic notarial acts.

Authorized Duties
• Administer oaths/affirmations;
• take acknowledgments;
• take verification upon oath/affirmation;
• witness or attest signatures;
• certify or attest copies;
• note protests.
• Limited governmental Notaries may notarize only for their employing Delaware state agency, or employing Delaware police agency (state, local, county or municipal). Duties are set by the agency. Service Organization Notaries may notarize only in connection with their organization.
