Delaware Notary Requirements

Delaware Notary Commission Qualifications
Notary applicants must:
• be at least 18 years of age;
• be a resident of Delaware or be regularly employed within the state;
• have a reasonable need for a notary commission;
• be of good character and reputation; and
• have had their civil rights restored in convicted of a felony and not have been convicted of a crime involving dishonesty or moral turpitude.

Appointing Officer
Governor - appoints notaries.
Secretary of State - maintains records, regulates.

Term of Office
NEW Commission - 2 Year Term.
RENEWING Commission - 2 or 4 Year Term.

Ink Stamp or Embossing Seal Required*

*Black ink specified for stamp. Seal impression must be photographically reproducible.

Authorized Duties
• take acknowledgments;
• administer oaths/affirmations;
• take verification upon oath/affirmation;
• witness or attest signatures;
• certify/attest copies; and
• note protests
Limited governmental notaries may notarize only for their employing Delaware state agency, or employing Delaware police agency (state, local, county or municipal). Duties are set by the agency. Service Organization notaries may notarize only in connection with their organization.
