New Mexico Notary Requirements and Information

New Mexico Notary Commission Qualifications
Notary applicants must:
• be at least 18 years old;
• be a resident of New Mexico;
• be able to read and write English;
• not have plead guilty or nolo contendre to a felony or been convicted of a felony;
• not have had a Notary commission revoked within 5 years of the date applying.

Notary Education and/or Exam Requirement
Education and exam required, new Notaries (and only renewing Notaries whose commissions have lapsed for more than one year).

Notary Bond Requirement
$10,000 Bond Required (4-year term)

Notary Recordbook (Journal) Requirement
Recordbook (journal) required, all paper and electronic notarial acts. Tangible or electronic format. Attorneys acting as notarial officers must maintain a recordbook when performing notarial acts unrelated to an established attorney-client relationship, and shall maintain only one recordbook at a time under this requirement “provided that” a Notary Public may keep a tangible recordbook for notarization of tangible records, and an electronic recordbook for notarization of electronic records.

Notary Seal Requirement
Ink stamp or embossing seal required; permanent ink specified. Seal image must be photographically reproducible.

Authorized Duties
• Oaths/affirmations;
• acknowledgments;
• verifications on oath or affirmation (jurats);
• witness or attest signatures;
• note protests (limited circumstances);
• certify or attest copies (including certifying that a tangible copy of an electronic record is an accurate copy of the electronic record);
• other duties as provided by law.

Allowable Fees (For the Most Commonly Performed Notarial Acts)
$5 per acknowledgment, oath/affirmation, and jurat. For copy certifications, 50 cents per page (minimum charge of $5). A travel fee is allowed IF it is disclosed and agreed-upon in advance, and the Notary explains to the signer that the travel fee is separate from the fee for the notarization and not mandated by law. American Society of Notaries recommends that travel fees be invoiced separately from notarization fees. Consult law and administrative rules for additional details and requirements.
