New Mexico Notary Requirements and Information

Temporary Notary Procedures, COVID-19 Pandemic: State Governors have issued Executive Orders to establish Notary procedures for using audio-video communications to perform notarial acts for remotely located principal signers. CLICK HERE to see if your state is under such an order.

New Mexico Notary Commission Qualifications
Notary applicants must:
• be at least 18 years old;
• be a resident of New Mexico;
• be able to read and write English;
• not have plead guilty or nolo contendre to a felony or been convicted of a felony;
• not have had a Notary commission revoked within 5 years of the date applying.

Notary Education and/or Exam Requirement
Not required for new or renewing Notaries. Education required, Notaries registering to act as Electronic Notaries.

Notary Bond Requirement
$10,000 Bond Required (4-year term)

Notary Recordbook (Journal) Requirement
Not required.

Notary Seal Requirement
• Ink stamp or embossing seal required, paper notarial acts.
• Electronic seal required/specified, electronic notarial acts. (Electronic seal contains information required in the paper-act seal; "generally corresponds to data" in the Notary's paper-act seal.)

Authorized Duties
• Oaths/affirmations;
• acknowledgments;
• verifications on oath or affirmation (jurats);
• witness or attest signatures;
• note protests (limited circumstances);
• certify or attest copies;
• other duties as provided by law.
• A New Mexico Electronic Notary may perform acknowledgments, jurats and oaths or affirmations.
