New York Notary Commission Qualifications
Notary applicants must:
• be at least 18 years old;
• be a resident of New York or have an office of place of business in the state;
• not have been convicted of a felony or certain misdemeanors; and
• pass the New York State notary exam. New York attorneys and court clerks of the Unified Court System are exempt from the examination.

Term of Office
4 year term.

Notary Education and/or Exam Requirement
Exam required, applicants for a new (initial) Notary commission. Renewing Notaries must take the exam if commission has lapsed (expired) for more than six months. Attorneys licensed to practice law in New York are exempt from taking the exam.

Notary Bond Requirement
Not required.

Notary Recordbook (Journal) Requirement
Recordbook required for ALL notaries (traditional and electronic), Effective January 25, 2023. Recordbooks must be retained in the notaries possession for 10 years.

Notary Seal Requirement
Not required.

Authorized Duties
• Oaths/affirmations;
• acknowledgments and proofs;
• take depositions and affidavits;
• note protests.
