South Dakota Notary Commission Qualifications
Notary applicants must:
• be a resident of the state of South Dakota or a resident of a county in a bordering state and is regularly employed in South Dakota; and
• not have been convicted of a felony.

Term of Office
6 year term.

Notary Education and/or Exam Requirement
Not required.

Notary Bond Requirement
$5,000 Bond Required (6-year term)

Notary Recordbook (Journal) Requirement
Not required for traditional (physical presence) paper notarial acts, or for notarization of a tangible (paper) document with the principal appearing before the Notary by means of communication technology.

Notary Seal Requirement
Ink stamp or embossing seal required, paper notarial acts.

Authorized Duties
• Take acknowledgments and proofs;
• administer oaths and affirmations;
• take verifications on oath or affirmation;
• witness or attest a signature;
• certify or attest a copy;
• note protests.
• With regard to tangible (paper) documents only, a South Dakota notarial officer may perform these notarial acts by means of communication technology, for a remotely located individual who is personally known. (The notarial certificate must be completed on the tangible document.)
